Board of License Commissioners
BYLAWS
I. Established. The Annotated Code of Maryland, Alcoholic Beverages Article
Section 16-201 establishes the Board of License Commissioners (Liquor Board).
The liquor laws for the State of Maryland may be found in the four volumes of the
Alcoholic Beverages Articles.
II. Purpose. The Board is an agency which regulates and controls the sale and
distribution of alcoholic beverages within Carroll County. The Board has the
authority to approve or disapprove applications for licenses to sell alcoholic
beverages and to revoke, suspend, and/or fine licensees who violate the liquor
laws.
III. Membership. The Carroll County Commissioners shall appoint the three
members to the Board of License Commissioners. The term of a regular member
is three (3) years. The terms of the regular members are staggered. Section 16-
202.
IV. Ethics. The Maryland Public Ethics Law applies to the members of the
Liquor Board as set forth in the Carroll County Code of Ordinances Section 34.03.
V. Removal. The County Commissioners may remove a member for
misconduct in office, incompetence, or willful neglect of duty. Section 16-202
VI. Substitute. The County Commissioners shall appoint one substitute member
to the Board to serve if a regular member is absent or incapacitated.
VII. Chair. The County Commissioners shall designate a chair from among the
regular members of the Board.
VIII. Meetings. The Board shall meet at least once a month at a place and time
designated by the Liquor Board. Special meetings may be called by the Chair.
Written notice of all meetings shall be posted on the County's website. Notice
shall be given at least ten (10) days in advance of all regular meetings. In order to
conduct a meeting, a quorum must be present.
IX. Quorum. Two of the three members must be present for a quorum to exist.
X. Amendments to By-Laws. The By-Laws may be amended during regular or
special meetings.
XI. Voting. All voting members may vote. Each voting member is entitled to
one vote. Unless specified otherwise, all voting decisions shall be decided by a
simply majority.
XII. Employees. The Board may employ a secretary, inspectors, and clerical and
other assistants as are necessary and set the compensation of the employees.
XIII. Rules and Regulations. The Board has adopted Rules and Regulations as
permitted by the Annotated Code of Maryland in Section 16-206. The last version
of the Rules and Regulations of the Board of License Commissioners for Carroll
County was adopted on February 11, 2015.
